This page explains the legal and professional boundaries of UpChar Setu. By using our website, doctor portal, or Android companion app, you acknowledge these disclaimers in addition to our Terms of Service and Privacy Policy.
1. Intended Users
UpChar Setu is intended exclusively for registered medical practitioners (doctors holding valid registration with the National Medical Commission or state medical council, as applicable) and their authorised clinic staff acting under the doctor's direction.
This platform is not intended for patients seeking medical advice, self-diagnosis, or self-medication. If you are a patient, please consult a qualified doctor in person or through a legitimate telemedicine service operated by a registered practitioner.
2. What UpChar Setu Is — and Is Not
- Is: A digital consultation companion for outpatient record-keeping, prescription drafting, patient history, follow-ups, investigations logging, and letterhead printing.
- Is not: A telemedicine marketplace, patient booking platform, online pharmacy, drug supplier, hospital billing ERP, diagnostic service, or artificial-intelligence diagnostic or treatment system.
3. No Clinical Decision-Making by Software
UpChar Setu does not diagnose medical conditions, select drugs, determine dosages, or issue prescriptions independently. Medicine search, autocomplete, shortcuts, and usage-pattern hints are typing and workflow aids only. They may display entries from master registries or the doctor's own prior usage patterns, but they do not constitute medical advice.
The treating doctor must exercise independent clinical judgement, verify every entry, and confirm the final prescription before it is printed, saved, or handed to a patient.
4. Prescriptions & the Drugs and Cosmetics Act, 1940
Valid prescriptions under Indian law must be issued by a registered medical practitioner in the course of their professional practice. UpChar Setu provides tools to help doctors document prescriptions; it does not replace the doctor's legal duty to issue a proper prescription, including compliance with applicable rules for Schedule H, Schedule H1, and other restricted medicines where relevant.
Doctors are solely responsible for the legality, accuracy, completeness, and appropriateness of every prescription generated through the platform.
5. Telemedicine Practice Guidelines (MoHFW, 2020)
Where consultations are conducted remotely, the registered medical practitioner using UpChar Setu must comply with the Telemedicine Practice Guidelines issued by the Ministry of Health and Family Welfare, Government of India (March 2020), including requirements relating to practitioner identification, patient consent, documentation, and prescription issuance.
UpChar Setu is a documentation tool; it does not by itself establish a doctor–patient relationship, verify patient identity, or ensure telemedicine compliance. Those obligations remain with the practitioner.
6. National Medical Commission (NMC) & Professional Ethics
Doctors must adhere to NMC regulations, the Registered Medical Practitioner code of ethics, and applicable state medical council rules. UpChar Setu does not supervise clinical conduct and accepts no liability for professional misconduct, negligent prescribing, or failure to maintain medical records as required by law.
7. Emergency & Critical Care
UpChar Setu is not designed for emergency medicine. Life-threatening or urgent conditions require immediate in-person evaluation at a hospital or emergency facility. Do not rely on this software for triage, emergency diagnosis, or time-critical treatment decisions.
8. Patient Data & DPDP Act, 2023
Patient health records processed through UpChar Setu may constitute sensitive personal data. Under the Digital Personal Data Protection Act, 2023 (DPDP Act), where applicable, the doctor/clinic acts as the data fiduciary for patient records, and UpChar Setu acts as a data processor providing secure storage and software services.
Practitioners must obtain necessary patient consent, maintain confidentiality, and honour data subject rights in accordance with applicable law. See our Privacy Policy for details.
9. Information Security (IT Act, 2000)
We implement reasonable technical and organisational safeguards to protect platform data. However, no system is completely immune from failure or unauthorised access. Doctors must also secure their devices, passwords, and clinic credentials. Notify us promptly of any suspected breach at privacy@upcharsetu.in.
10. No Medical Outcome Warranty
UpChar Setu is provided on an "as is" and "as available" basis for administrative and documentation purposes. We make no warranty regarding patient outcomes, treatment success, pharmacy acceptance of prescriptions, or regulatory approval of any clinical decision made using the software.
11. Limitation of Liability
To the fullest extent permitted by applicable law, UpChar Setu, its owners, and service providers shall not be liable for any direct, indirect, incidental, or consequential damages arising from clinical decisions, prescriptions, patient harm, data loss beyond our reasonable control, or non-compliance with medical or data-protection laws by users of the platform.
