Please read these Terms of Service ("Terms") carefully before activating your subscription or installing the UpChar Setu Doctor Companion Android application.
1. Service Definition
UpChar Setu is a digital consultation companion for doctors: patient records, consultation history, prescriptions, follow-ups, and letterhead printing. The Android app may save work on the device when offline and update your cloud records when you are online again. The software does not diagnose or treat patients.
2. Medical Accountability Disclaimer
IMPORTANT: UpChar Setu does not override or substitute clinical judgement. Medicine search, autocomplete, and usage-pattern suggestions are typing aids only. They do not diagnose, recommend treatment, or prescribe on their own. The treating doctor must review and confirm every prescription line before printing or sharing with a patient. We assume zero accountability for clinical advice issued by doctors using our tools.
3. Regulatory & Compliance Notice (India)
UpChar Setu is a doctor-controlled clinical documentation and prescription companion. It is not a telemedicine marketplace, online pharmacy, drug vendor, or AI diagnostic system. Use of the platform must comply with applicable Indian laws and professional guidelines, including the Telemedicine Practice Guidelines (MoHFW, 2020), National Medical Commission ethical standards, the Drugs and Cosmetics Act, 1940 (including prescription requirements for restricted medicines), the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023, where applicable. Doctors remain solely responsible for patient care, valid prescriptions, informed consent, and record-keeping obligations.

4. Eligibility — Registered Medical Practitioners Only
You represent that you are a registered medical practitioner (or authorised clinic staff acting under a registered practitioner) and that you will use UpChar Setu only for lawful clinical documentation within the scope of your professional registration. Misrepresentation of professional credentials may result in immediate account termination.
5. Prescription Responsibility
Every prescription generated, printed, or shared through UpChar Setu is issued under your professional authority. You must verify patient identity, clinical indication, drug name, strength, dosage, frequency, duration, and instructions before finalising any prescription. The platform never auto-prescribes or auto-signs on your behalf.
6. Device Licensing
Plans may limit the number of active devices. Registering devices beyond your plan limit may require a subscription upgrade before all devices can access the service.
7. Acceptable System Usage
You agree not to reverse engineer the companion app sync protocol, overwhelm API endpoints with scrapers, or attempt to bypass rate-limiting controls. Violating these usage terms will result in immediate termination of the clinic tenancy.
8. Account Security
Practitioners must secure their access credentials. Modifying security passwords signs out all active sessions instantly on that tenancy. We suggest utilizing secure multi-character passwords.
9. Limitation of Liability
To the fullest extent permitted by applicable law, UpChar Setu shall not be liable for clinical outcomes, prescribing errors, patient harm, regulatory penalties arising from your use of the platform, or losses beyond our reasonable control. Our total liability for software service claims shall not exceed the subscription fees paid by you in the twelve (12) months preceding the claim, except where liability cannot be limited under applicable law.
10. Updates to Terms
We reserve the right to modify these Terms. Subscription renewals constitute agreement to any modified Terms. For contract inquiries, please reach out to legal@upcharsetu.in.
